November 18, 2020: automatism, mental disorder, the following class we will consider defences. 1 (a) everyone is a party to an offence who actually commits it: also known as the principal - person who commits actus rues with mens rea. Everyone is a party to an offence who: does or omits to do anything for the purpose of aiding and person to commit it; or, abets any person in committing it. General principles: a person who aids or abets an offence is equally responsible in law as the principal, need not be present when the crime is committed, mere presence at the crime is not generally sufficient. Aiding or abetting - actus reus and mens rea. Abetting: actus reus = encouraging, promoting, procuring, or instigating an offence, mens rea = the intent to encourage and knowledge of what the principal is intending to do.
