48 views5 pages

Document Summary

Un declaration = undeclaration of basic principles of justice. Old definition of victim: a person who have suffered physical or emotional harm. Victim is defined as one who suffers physical or emotional harm, or financial loss, as a result of a crime, in case of death, victim includes immediate family. Aspiration document: sets out principles (courtesy, compassion, and respect) but does not guarantee rights. Limitations: does not supersede any other laws. Unenforceable: does not have any teeth, not enforceable. The judge is saying that this is wishful thinking. We should consider to not interfere with the reasonableness and the consistency of other laws. No remedy for any rights if they are not respected. Can be frustrating because the victim participated and delayed the trial. Threaten the decisions of the crown attorney. Potential solution: provide more funding to crime prevention strategies. Not intervening in international issues, so if the offender or victim let the country, their are no guarantees.
