Section 8 of charter about search and seizure. Courts now recognizing computing devices and virtual places as actual places. Simply treated as a communications device it"s limited for owners to expend privacy concern over those devices. A laptop is a place not a mere tech. device so they are protected under privacy rights. It"s an employer owned laptop, question becomes what expectations if any do employees have for their privacy right. Useful to morelli and cole as they are about privacy. Cellphones are different from places from r v. vu. On an employer owned computer cole had child pornography. Diminished to what extent is what"s analysed and necessarily subjective. He has an expectation of privacy but characterizing it is hard, it"s subjective meaning it"s not absolute or objective. Some companies operate differently meaning different rules/policy in place which directs extent to which employer is allowed to search your data.
