Section 10 of the charter of rights and freedoms: Involves the police power to retain an individual- in effect, to deprive an individual of liberty. (goff, 222) In order to arrest someone, police must have reasonable grounds. Once determined should be charged- police have several options: Arrest and release (order to appear: no arrest, but required to appear. What is an information: one lays an information when one presents to a judge a sworn written allegation alleging the individual named in the document has committed an offense. Informations are also used to obtain search warrants. (goff, 430) An authorization that grants an individual, usually a police officer, to do what is specified in the warrant (e. g. to arrest someone). (goff, 433)
