Day 9- wed, oct 14th, 2015: provisions under the charter: See in official course notes : to be tried in a reasonable time, self-incrimination: Charges was dismissed because the police took too long to get to court. Court made a statement which delay over 8 months were reasonable. All the lower courts took that as a standard (8 months) Right to be informed that your statements will be used in court. These are not universal rights because many countries uses these rights. Usually seen as evidence of guilt if you choose not to take the stand: commonly known as a presumption of innocence. You can"t be punished until you"ve done something guilty. Civil matters: same thing applies: double jeopardy. Not defined as what is cruel and unusual, it is up to the judge to decide. S. 13, if you are a witness and make use of the charter, the evidence can"t be used against you.
