Document Summary
Chapter 3: the organization of the law, pg. Crime: public wrong, signals that harm represented by the act requires punishment. Goal of state administered punishment is to deter the specific offender from committing further crimes (specific deterrence) and to deter members of the general public from committing offences by making an example (general deterrence) Person accused of the crime be shown to have been possessed of an evil intent (mens rea) when the evil act (actus era) was committed. Tort: wrong committed against the private interest of an indiv. , corporation, or gov. Wrong committed may be intentional, or due to negligence. Torts are viewed as less serious than crimes, as the harm that has been done is limited to specific indivs. or organizations. It is left up to party that has been wronged (plaintiff) to file an action in court to have the wrongdoer (the defendant) punished, usually in form of payment of damages.
