Law and social change: law is determined by the sense of justice and the moral sentiments of the population, and legislation can only achieve results by staying relatively close to prevailing social norms. Social change comes first, legal follows: law, and especially legislation, is a vehicle through which a programmed social evolution can be brought about. Basic characteristic of modern society: growing use of law as a device of organized social action directed toward achieving social change. Social change through legislation vs social change through litigation. Efficacy of law as an instrument of social change. Institutionalisation of patterns of behaviour: establishment of a norm with provisions for its enforcement. Internalization of patterns of behaviour: the incorporation of the value or values implicit in a law. Conditions influencing the extent to which law is successful in inducing changes: reflects majority opinion.
