Week 2: sentencing theory: proportionality, rehabilitation, retribution and. Sentences should aim to reform the criminal tendencies of offenders. Major model used in most of the 20th century, and very popular in the (cid:883)96(cid:882)"s: decline then due to publicity given to negative research findings. Rehabilitation attempts to foster law-abiding habits which are intended to change offenders attitudes and inclinations. A consequentialist approach for compulsory social intervention: at the very least we can avoid unnecessary harm resulting from excessive or damaging penalties. Some argue that the state has a duty to provide programs and treatment opportunities for offenders. Many who are convicted of offences are people who are socially or otherwise disadvantaged: state can compensate for this disadvantage by offering treatment. Believes that an offender"s condition can be diagnosed and an appropriate treatment can be made available: i,e drug or alcohol issues, mental issues.
