Pols 3130 lecture 5 september 21, 2016. Large jurisdiction: can hear almost any legal issue. Trial courts level: in ontario it is the superior court of justice. Appeals from s 92 courts and provincial administrative tribunals go to s 96: hear cases in panels. 3-5 judges: ontario human rights tribunal, landlord/ tenant dispute. Serious criminal charges: unlimited jurisdiction, jury trials. Torts and private law over certain amount (10"000$) Family law: divorce, custody and support happenhere, all other family law is in 92. The scc has had to answer reference cases protecting the powers of s 96 because they are constitutionally enshrined. The provinces wanted to create tribunals to invest decision making authority: for costs, and to take pressure off the courts. Criminal law is unlimited, but most jurisdiction has been delegated to s 92: efficiency. Complicated because of the division of powers: fed. Marriage and divorce definition: provinces power to grant licenses and make rules.
