Rules outlined in the supreme court act. Federal gov"t appoints: prime minister very involved in appointment, canada is the only democracy where the decision is virtually the pm"s alone. Required to be judge of lower court or member of bar for at least 10 years. 3 judges must come from quebec: by convention we have 3 from ontario 2 from west and 1 from east, when judge retires they are replaced by someone of their region. Must live within 40 kms of national capital region. Tenure on court, with good behavior: mandatory retirement at age 75. The pm meets with people from legal community of important region. Get advice from chief justice: who have consulted with the attorneys general from region, and chief justices from regional courts. Minister provides recommendations to minister: then pm chooses and recommends to cabinet, and there will be no talking back on the matter people go with the decision.
