Before the charter, it heavily depended on how much money you had. 1st fundamental reality: getting issues resolved through the court system depends on the money you have to spend to go to court. Cost of accessing the court system is excessive. Laws in canada fall into 2 general categories: public and private laws. Public laws: legal rules that impact society as a whole (ex: criminal, constitutional, administrative) Private laws: legal rules that concern the relationships among individuals and organizations in matters that don"t have broader public concern. Includes laws that regulate corporations, organizations, contract, etc. If contract is broken, it can be taken to court. Private law is based on 2 distinct forms of legal systems in canada. Both have differences in ways of operating and in outcomes.
