Rule of law- maintain a democratic, well ordered society. Magna carta- first royal proclamation of basic human rights. Ten commandments- form the moral basis of law. Morales- individual interpretation v. law- set in stone for all of society. Adolf hitler pulled a fibre during his leadership campaign and it led to the holocaust. Common law- precedence setting cases that have advanced or changed the law. Distinguishing case- choose the precedence of one case over another. Stare decisis- system of following law through precedence. Court of chancery (equity)- old british legal system for lords who would appeal to the king over contracts. Statute law (paramountcy)- written laws that create a code ex. Legislation passed by federal, provincial, and municipal levels of government. Parliamentary supremacy- laws of parliament trump any court decision.
