Comes from existing legislation, charter of rights and freedoms, canadian constitution, indian act, platforms of political parties. The former british government had a protectionist policy towards aboriginals: created a buffer between aboriginals and europeans, create advantages to allies, the colonial government was very worried about the usa launching an attack, 1812 war. Thousands of aboriginal warriors involved: battle of little acorn. Singbull came to canada and was turned away with thousands of his people. Assimilation policy: first nations people should abandon traditional ways and join the european way of life, bill c-31 was to correct it, enfranchisement approach, incentives for natives to give up status, potlatch laws in 1881. Government saw this as crazy cause they would give things away to each other. Many natives were incarcerated when this became outlawed.
