Insanity defense is at a trial: prior to the accused person"s guilt. Trial in the middle of the 19th century: m"naghten rules. Basis for law regarding the role of mental illness in legal responsibility. Daniel m"naghten set out to assassinate the prime minister: killed someone else by mistake. M"naghten claimed he was instructed by god to do so. Verdict claimed that he was oblivious to what he was doing and did not believe it was wrong. Insanity is a legal term: ncrmd not criminally responsible for their acts on account of mental disorder, included in secion 16. No one is responsible for doing something or an omission while sufering a mental disorder. Before regina v. swain individuals could be kept at the pleasure of the lieutenant governor for an indeterminate length of ime: bill c-30 decided that was against the charter of rights. Review board can discharge someone with or without punishment, extend isolaion etc.
