Crim 332 final week (dec 1st, 2016) To be better than we are : the promise of the charter. Ignatieff (2013) reminds us that the charter is a legal, moral and political document . It upholds the law at both the national and international level, consistent with universal moral norms and human rights obligations : human right approach. Silences and limitations: it has proven difficult to use the charter to successfully frame and advance broad-based demands for social change (think gender inequalities, economic and social rights -> homelessness: e. g. 20 years between rodriguez and carter and bill c-51. Not a perfect document but never finished business : law is not static, it is changing, our engagement is continuous. Metaphor of a living tree : think of criminal code and changes. Legal equality vs. substantive/social inequality ignatieff mentions increasing income inequality (think back to lack week"s reading) law on its own is not adequate enough for social change.
