Assault is an example of being a tort as well being in the criminal code. You can be charged under assault under the criminal code. You have the right to sue for damages as a result of the injuries sustained from assault. Crown prosecutes, criminal on behalf of society. Object = punishment, protection of the public. Determination of guilt: all or nothing, either right or wrong, no middle ground. Assault (crime under criminal code / intentional tort) Criminal negligence (being hit by a car)
