Esa: the min. standard, the floor, employer cannot give less than that. The act has a purpose clause that is the reason or the why it is needed. Any ambiguity will be interpreted in light of the purpose section of the act. Can not enter an agreement less than the act and if the contract is silent then the act still applies. Act does not apply to people who are not employees. employee includes (a) a person, including a deceased person, receiving or entitled to wages for work. Performed for another, (b) a person an employer allows, directly or indirectly, to perform work normally. Non-employees can be people who are in business for themselves. Two questions to see if a person is covered: All are employees except those excluded by regulation under their own special act that govern them (ex. Forester act) or do not need the protection of min. wage and flexibility.
