Personal liability = 2 person being held accountable when their wrongful conduct causes injury/loss to another. Or when someone drives carelessly or defames another, the conduct itself is unacceptable, hence wrongful, criminal conduct also must be distinguished from a tort: e. g. assault, battery, false imprisonment, trespass, defamation, deceit, nuisance, negligence. 2 categories of torts: intentional torts deliberate conduct (not necessarily the injury, but the conduct leading to it involves a deliberate act, negligence conduct leading to the interference was inadvertent. Assault & battery (form of trespass to person) = involves intentional physical interference w/another: assault = threat to harm another. If threat of violence is immediate & possible, assault has taken place. Threatened interference =/= need to be harmful, just unwanted. E. g. pointing a gun @ someone victim"s fear or apprehension of that contact; even if no bullets, victim still thinks gun is loaded: battery = takes place where there is actual physical contact.
