The process by which a neutral third party, upon being asked to do so, helps parties negotiate a dispute. The mediator helps organize and control process, but leaves decisions up to parties: defining mediation absolutely or with clarity is difficult because: Mediators can"t always avoid getting involved in substantive issues. It is sometimes used in mandatory schemes that focus on settlement as success: mediators should see their role as: assisting in establishing an open, positive, and trusting negotiating atmosphere. Helping plan the steps to be undertaken throughout the process. Helping frame the issues to be dealt with and helping parties prioritize those issues. Helping parties explore their underlying desires, hopes, fears, and concerns: mediators should: Promote problem solving on the basis of the parties" own perception of the facts and their interests enable the parties to save face where possible. Evaluative involvement / non-evaluative involvement: western historical tradition dictates that rules and laws keep humanity from descending in chaos.
