When you"(cid:396)e looking at a dev application you have to decide whether or not it conforms to the op. You look at it to see if it interprets it: courts say op is not statue, op is adopted by council. When a court looks at something, their looking to see if their policies are law and correct - statutory interpretation. Rules of statutory interpretation: looking at overall intent for objectives and look to what the policy means, green land policies along the lines , ex. You cannot do a, b, c: woodlands, 1. Gghs and that no by law can pass if it does not conform to the op: key document is op when assessing development application. Approval authorities: once the op is adopted from municipaility it goes to approval authority and they have 180 days to make a decision. If a plan is exempt from approval, the appeal period begins.
