MHR 522 Lecture Notes - Lecture 7: Arbitration Clause, Bargaining Unit, Collective Agreement
Document Summary
Grievance: an alleged violation of a collective agreement, mostly filed by unions, not all complaints about workplace life meet the definition of grievance, can be large or small, can relate to a wide variety of issues. If not resolved during the time-limit, the grievance automatically proceeds to the next step: time limits can be waived by mutual consent. Step 1: filing the grievance: sometimes oral, sometimes written form required, to immediate supervisor. If there is a difference of opinion about the interpretation of the collective agreement, the employee is obligated to work now, grieve later (unless they refuse unsafe work) Step 2: slightly more formal meeting, yet still at lower levels, limited external influence, both parties present evidence, along with a recounting of the first two steps of the procedure, parties attempt to reach a mutually satisfactory solution. Step 3: usually final attempt to resolve grievance prior to possible use of arbitration.
