Abc has been charged with that offence and at trial the prosecutor brings evidence and shows the proof that abc committed the offence and than states abc should be guilty because its proven. Since the prosecutor proved that abc is guilty, abc should be charged. The prosecutor is suggesting that this is an absolute liab. In this case it is clear that it is an absolute liability offence with a high fine of 40 000$. The defendant is arguing that it is unconstitutional for this to be an absolute liability offence as there is a lot of stigma behind it and that the defendant should have the right to speak in court.
