Even though indigenous people account for only 5% of the population, they account for. 24% of the population custody in federal prisons. About 30% of indigenous people are in the provincial institutions. Men are overrepresented in the provincial prisons. Women are underrepresented in the criminal justice system. Women come into court for mainly non violent crimes as compared to men who are brought in for more violent offences. Historically, there have been two theories to explain the representation:
