Penology the study of the disposition of offenders. Judicial determination of a legal sanction to be imposed on a person found guilt of a crime. Sentencing is the process of guring out the legal sanction. Prisons weren"t invented for punishment, they were a holding facility and now prisons are the way of punishing people purposes of punishment. Lots of discretion but some guidance in terms of mandatory minimums and max penalties. Max penalties - issues ; penalties are too high and do not correspond to relative seriousness of offence. The max penalties don"t provide good guidance to judges on what the society wants. Mandatory minimums - in plea bargaining they ensure cases don"t get to the stage so there is no mandatory min applied. Utilitarian" or forward looking goals , linked to instrumental purpose. Retributive goals , retribution, just deserts & denunciation.
