Law 201 week 11: contracts part 3 & 4. A contract is an agreement that law will enforce . All contracts are agreements, but not all agreements are contracts not all agreements are enforceable. Intention to be bound in law: parties have to be aware of the legal aspects and intend an agreement to be a legal one. Each party must confer or promise to confer something of value on the other party: consideration = the thing of valuethe price for which the promise of another is to be bought. a. i. a. ii. The promise to charity the promise to give a gift isn"t binding, giving a party something to do as they see fit with no parameters is not a contract (dalhousie college v. boutillier case) Not enforceable: the sanction involved in the breach of contract is not a legal sanction, but a moral or social one therefore it means there is no remedy available in law for its breach.
