Understanding moral issue confronted with and think reasonably and decide reasonably about it. Little agreement on how doctors are suppose to make this decision. Focus on patient"s medical capacities, specifically their capacity to make an informed medical decision. Assessment should eliminate two errors: preventing a competent person from participating in treatment decisions, failing to protect an incompetent person from the harmful effects of a bad decision. Inappropriate that a physician demand a patient to have all these 3 characteristics. If go to emergency room, may not have capacity to do so. Need more nuanced understanding of how doctor"s should assess patient"s understanding and decision making (competence) Goal of standards is to provide workable guide for clinical decision making. 3 situations a person might face: standard 1: type of decision. Those where the medical treatment is not dangerous and which are objectively in the patients best interest (obvious)
