Freedom of expression: one of the most valuable freedoms in western democracies, recognized in all modern democratic societies (fundamental de nition) Despite premium placed on free expression, almost all legal systems recognize limitations: defamatory false statements, statements likely to cause panic and result in serious harm, statements provoking retaliatory violence ghting words d, publication bans in some trials, etc. Free expression & charter: possibility of limitation built right into canadian charter, sec. 2 subject to sec 1 reasonable limitations clause & oakes test: a a rule, especially strong reasons necessary for limits to free expression. Consequentialism: actions, policies, laws judged in terms of good&/or bad consequences. Deontology: inherent or intrinsic good ness or badness of act can count too, some actions intrinsically wrong or right regardless of good or bad consequences, nature of act and torture itself. Consequentialist arguments for free expression: truth discovery: November 11, 2015: special value of artistic expression.
