Factors determining fair use: purpose: nonprofit/educational or commercial, nature of copyrighted work, amount of the copyrighted work used, effect of the use on market value of the copyrighted work. Fair dealing: term for copyright exception in canada. Stricter than us fair use policies until 2011 when bill c-11 (copyright modernization act) was passed. Ability to use works that fall under fair dealings and don"t need permission or pay royalties. Prior to bill c-11, permissible purposes for fair dealing only included: research, private study, criticism, review, news reporting. Proper citation/sourcing of copyrighted material was required even under fair dealing. Bill c-11 passed after 4 unsuccessful tries, finally passed in 2011 (has been around since 2005). Features wide rage of user-oriented provisions that legalize common activities. Now covers three additional purposes: education, satire, parody (total of 8) Importance: protects creators of non-commercial user-generated content such as remixed music, mashup videos, or home movies using commercial music ( youtube exception )
