Must be unique, but trademarks do not need to be, in order for it to be used. Top level domain name - only one person to have the right to have a . com. Second level domain name - name/title of website. More difficult to prevent someone from getting a domain name that is associated with another"s name, service, brand, etc that is in attempt to impersonate existing disputes. Registering, trafficking in, or using an internet domain name with bad faith intent to profit from the goodwill of a trademark belonging to someone else. This can involve an intent to profit off of the sale of the domain name, or the deliberate use of misspellings for the purpose of diverting internet traffic. Setting up a website that is designed to profit off of someone else"s work with bad intentions.
