only when it can show compelling interests
-Nussbaum - equality “rights” represent compelling state interests
-State commitment to equal justice is not to be abandoned
-Concerned about the violence that can happen between families
-Justice can be denied to certain people based on how the state views their family
-Areas of rights concerns:
1) life and health issues, 2) right to body integrity, 3) employment rights, 4) mobility and
assembly rights..
-Nussbaum’s recommendations:
-Religious freedom should not be allowed to trump sex equality
-No delegation of family law to religious courts if it entails gender inequality or religious
discrimination
—> Delegation if gender equality concerns can be met
—> Application of equality norms to religious laws
-Religious actors should be accountable to state laws
-Constraints on religious speech
-Encouragement of liberal elements in religions
-The family for Nussbaum is what the state says it is
-Veiling and Islam
-Banning the Niqab

2011- France bans face covering veils and masks
2012 - R.V. NS (sexual assault)
-Different forms of veiling: burkina ban (France)
-Why ban the niqab?
-Symbol of non-integration, symbol of women’s oppression, front of secularism, tool for
intimidation or proselytism, impolite, limits communication, security threat to others/safety
