Both federal and provincial governments have the power to create statutes in either parliament or legislative assembly. Statues usually contain regulations, which are also laws but refine specific details of the statues. Eg motorcycle helmets - mandated by sec 104 of the hta but described in detail by regulation 610 rro 1990. However, a bylaw in one municipality may not apply in another municipality. Provides an operating framework for all provincial statutes. Prosecution of provincial states takes place through the ontario court of justice. General limitation period is 6 months but some statues have exceptions specific to that statues. Part 1 (from 3) - used for most offences that are minor in natures - e. g. speeding (served within 30 days ) Summons (form 7) under part 1 up to 30 days. Part 2 - dedicated to parking infractions. Part 3 (form 104) - reserved for the most serious offences and punishments.
