This is the 4th and final phase" of the labour relations process as set out at the start of the course. Sets out ability of management to direct company operations. Such ability is constrained by the language seen in the collective agreement. Estopppel (important will be on the final test) a legal concept one party to the union contract engages in a practice different from what is stated in the collective agreement. In general terms, one party has come to rely on a practice that the other party has committed to outside of the agreement. It became the new standard, and once you do that whatever party committed to the practice (whether the union or party) is estoppel from the term of collective agreement. The only way out of it is to bargain. The union will argue that this is an estoppel issue; union came to rely on that practice.
