Only have the right to the jury when you comment certain type of crime. Three types of crimes in the canadian criminal code: No jury, only judge will hear you. Serious crime like rape, murder where you do have a right to a jury. Certain cases where it will be treated of a summary offence or indictable offence. Community consciousness tried by the peers and they impose the view of canadian society. Jury quiddity: when someone did a crime but the society or jury doesn"t think it should be a crime such as an abortion act. Not sentencing juries do not sentence, they decide guilt or innocence and the judge sentences: representativeness. Random selection from community (we restrict who sits on a jury though such as lawyer, first responders) Representative of community: impartiality (not bias, not going to court with a preset mind)
