Fitness to stand trial: assessment of the current mental condition of the accused. De ning fitness (1836): in relation to their mental illness and how it impacts them. Criminal code: unable, on account of having a mental disorder, to understand the nature of the proceedings, understand the consequences of the proceedings, or communicate with counsel (lawyer must prove this) Could take between 5 to 30 days for assessment orders done typically by psychiatrists or a medical practitioner. Fit-r test identi es if you have a mental illness and if it impacts x issues. Cover main issues in section 2 (understand possible pleas, understanding of consequences, communicative with counsel) Maccat-ca: tness to go to trial and tness to plead guilty. Questions grouped into 3 sections: understanding of the legal system, reasoning ability, understanding of own legal situation. Un t: held in hospital before trial in a secure psychiatric facility.
