General part of the criminal code (vs special part) One thing that they did was clarify the general part of the criminal code (the section that outlines its principles, at the beginning, the moral part of the law. Criminal liability and defences where we can find the principles of criminal law. Found that the general part has several functions (organize, rationalize, illuminate) Retribution: harm done, the state wants to punish to restore the balance. Protection from harm: reduce harm, reduce harm in society. (goal accepted) We want them. , like human dignity, freedom and autonomy) Lrcc also found that when a harm is done, or underlying value is breached, it provides reassurance that justice will be done, that harm will be balanced. And then it protects from violence against society. Mere offences violate useful rules while crimes violate necessary or essential rules. Crimes are more obvious wrongs than mere offences: not as purposeful as a true crime offence.
