There cannot be an agreement without a consideration whether it be of equal, lesser, or more of an exchange. Stilk v. myrick 1809 kb 1: facts action for extra seaman"s wages promised to cover for 2 deserters. Plaintiff was contracted to work on a ship for 5$/month, promising to do anything needed in the voyage regardless of emergencies. Two men ended up deserting and the captain promised crew the wages of those two men decided between them if they fulfilled the duties of the missing crewmen. In the end the captain refused to pay the crew the money he had promised them arguing that there was no consideration present (because they were already bound to do the work).
