The formation of criminal law was created to distinguish what is a crime against state or against the person. 14th-15th century brought a rise in capital punishment. Capital punishment was made public to show the population the power the state had to install fear. Rusche and kircheimer proposed a link between punishment and political economy. Whether bodies are needed or not for the economy. When a society needs workers, human life is more valued more tolerance. Dario melossi said that political uses of law will vary with economic cycles. In periods of economic insecurities, politics will use law to show that they still have control. Growing empires saw the potential of criminals; they used them as slaves in galleries to improve the military. Penal transportation: sending convicts to colonies, to alleviate labour shortages. Problem with that was the advancement of the atlantic slave trade (african slaves).
