Some offenses will always be crime, even if theyre not criminalized, where as other crimes will only be crimes because of their actual criminalization. Example : murder & rape (malum in se) Raffaele garofalo natural crimes, basically looking at all the variations of crime & how we can build a science of crime with criminology that is not dependent of criminal code. Criminology will be the study of what they define as natural crimes, so anything that goes against human nature. He was positive that humans were inclined towards pity, so we are naturally inclined to be loyal, compassionate etc. Natural crimes would be crimes that violate these inclinations.
