Week 4 courts: trials, evidence and determining guilty. Most cases are filtered out before a trial (the funnel model) The police can divert people away from the cjs for example by giving cautions to youths/first-time offenders or through other programs e. g. restorative justice conferencing. These offenders aren"t completely let off" > need some acknowledgement of guilt e. g. financial penalty, written apology. The police can issue summons to appear in courts. Police bail > offenders released for a charge. Unconditional bail > must turn up in court on a specified date but no other restrictions. Conditional bail > bail but have certain conditions they have to abide by e. g. a curfew, confiscated passport. Court bail > when an offender is held in custody until they can appear in court. Usually police bail is refused if there"s a chance of the offender fleeing, reoffending or intimidating witnesses. Charges can change/be minimised or withdrawn e. g. reducing murder to manslaughter.
