This week perhaps for the first time in your life you will be exposed to legal cases. If you have absorbed the lessons of the first topic, you will know why we (in a common law system) rely so much on case decisions from the past. The doctrine of precedent relies on past cases, to guide future decisions. A professional lawyer will refer to original law reports when studying cases. A discussion of law reports, and sample pages from a law report, are provided in your topic 1 materials. For our purposes studying the law in order to understand its commercial implications we will be using case summaries. These case summaries are provided in your textbook. The very first case that we will encounter is the mabo (no 2) decision, in our first week of lectures.
