• IRAC- What are the legal issues? (Most contentious to least contentious) What are
the legal rules? (Apply issues to relevant facts) What is your argument? What is
your conclusion?
• In a take home assessment include date in case law citation but in exam can just put
party names
• Write a small intro and conclusion to each issue not the whole problem question
• Conduct IRAC for each issue
• Australian Guide to Legal Citation
• Reading a Case- Writing Case notes-
- The ratio is the only part of the case that is binding
- MIRAC-
- Material Facts (Relevant Facts)
- Issues (legal issues surrounding the relationship between the law and the facts)
- Rules (ratio/reason for decision)
- Application of rules to facts
- Conclusion (Decision)
• The ratio is the reasons why the court came to the decision
• It’s only an issue as opposed to a fact really if there is contention around it
• Tips for surviving law school-
- Attend lectures and Seminars in person
- Do readings and notes early (don’t cram)
- Conduct practice exam questions because they’re not essays
• Attend Next Steps Program to prepare for graduate possibilities- networking events
etc.
• Next networking event is Thursday 2nd March 12-1:30pm
