POL 102 Chapter Notes - Chapter 8: Twenty-Fifth Amendment To The United States Constitution, Twelfth Amendment To The United States Constitution, Pendleton Civil Service Reform Act
Document Summary
State the constitutional qualifications and succession requirements for the presidency. Article ii , section 1, of the constitution states that the president must be a natural-born citizen, at least 35 years old, and a resident of the united states for 14 years. It did not specify the eligibility of the vice since the vice would be who came in second to the vote for president. When the president is incapacitated or unable to perform his duty then the vice takes over. If neither can perform their duty then congress designates a successor by law. Presidential succession act (1792) designates the president pro-tempore of the senate as next in line, then the speaker of the house. The 25th amendment ratified in 1967, required the president to nominate a replacement vice, who must be approved by a majority of the house and the senate. The 22nd amendment limits the president to two elected terms.
