Section 2(1): cpa applies to all consumer transactions if the consumer or person engaging in transaction with the consumer is located on ontario when transaction takes place, except those mentioned in section 2 and s. 2(3) This act does not apply in respect of: (a) consumer transc. regulated under the securities act (b) financial services related to investment product (c) financial products regulated under the insurance act. In determining whether this cpa applies, a court shall consider the real substance of the entity or transaction and in doing so may disregard outside form.
