The courts don"t always assume a proacive or a leadership stance. Finally, agencies may incur greater civil liability whenever a irm policy is not in place. Today, the courts would look at such a guideline, along with the absence of any appropriate training as an unwarranted deliberate indiference by the organizaion and view the oicers acions with askance. The supreme court has ruled that the lack of a writen policy does not insulate an agency from subsequent liability.
