Document Summary
A wide variety of documents are needed to establish title, transfer title, and track ownership rights in real property. A written document used to transfer ownership of real property. No estate or interest in real property, other than lease for less than 1 year, can be created or transferred other than by operation of law or by conveyance or other instrument in writing. Has to be in writing to sell land. Grantor with legal competency to execute the deed. Granting clause (do grant, transfer, sell, convey etc. ) Habendum clause ( to have and to hold limits quality of estate. Deed does not need actual dollar amount being transferred) no habendum clause presumes a fee simple title. Accurate legal description of the property conveyed. Nobody else will have a claim on the title. Person conveying land will defend the transfer. Resolution by board of directors of other authority identified in bylaws.
