Common law vs civil law: common law. Business law 201: chapter 1 court case decisions create and interpret the law courts look to established precedents in order to interpret the law. Used in the usa, canada, and england: civil law codes, not previous case decisions, form the law. Substanive areas of law: substanive law creates, deines, and regulates rights and liabiliies crimes are serious violaions of substanive law torts are civil wrongs against others. Malpracice, fraud, defamaion, etc: procedural law speciies the steps to be followed in enforcing substanive law. Naional and state: case decisions federal and state court systems, statutory (codes) Uniform commercial code to facilitate business between states: administraive agencies establish rules and regulaions, internaional agreements treaies and convenions, private law sets up rules that apply to individual private transacions. Contracts vs torts: contracts voluntary agreement detailing the rights and obligaions of the members, torts (civil wrongs) Obligaions imposed by law when a civil wrong is commited.
