Document Summary

Chapter 2 the social context of dispute settlement and the rise of law. The general goal of dispute settlement processes is to restore order. However, the nature of the social order, and the groups that have gained the most advantage as a result of that order, have changed significantly. Without underestimating the often harsh realities of life in small-scale societies, there is no question that such communities were characterized by a strong collective solidarity. Another factor that increased solidarity was the relative absence if resource inequality. Living in a subsistence economy, where little or no surplus could be generated, made it necessary for the group to share the fruits of the day"s hunting or foraging. Collective solidarity: a state of social bonding or interdependency that rests on similarity of beliefs and values, shared activities, and ties of kinship and cooperation among members of a community.
