Document Summary

Chapter 4 notes: 4 fundamental questions of property law: How are ownership rights established? rule of first possession = the first party to use an unowned resource acquires a claim to it. What are the remedies for the violation of property rights: the legal concept of property, from a legal viewpoint, property is a bundle of rights. If the negotiations break down and the parties fail to cooperate, their attempt to shift resources to a more valuable use will fail, and they will not create value. Thus, the obstacle to creating value in a bargaining game is that the parties must agree on how to divide it. If the parties fail to cooperate, they will each achieve some level of well-being on their own: the surplus from cooperation is the difference in value between cooperation and noncooperation. In any voluntary agreement, each player must receive at least the threat value or there is no advantage to cooperating.
