People might want to settle differences outside court eg businesses seek private adjudication. Interest-based approach = focus on the problem itself: mediator encourage party to explore experience and issue underlying the conflict, focus on the problem itself, rather than on exploring broader issues related to the parties" identities and relationships. Both transformative & narrative mediators assume that probing for information about the problem keeps disputants locked in the conflict, and to help them achieve resolution requires a shift in focus away from the problem. Like transformative and narrative, insight sees relationships and interdependence as cornerstones of conflict. General process : 1) establishing the process - the parties and mediator together establish the protocols for the mediation. Direct insights: a ha movements insights that occur dramatically, from confusion to sudden awareness, insight mediators devote much of their attention to probing for direct insights.
