Once a union is certified (or voluntarily recognized), it gains statutory authority as the exclusive representative of all employees in the bargaining unit. One implication of this is that there may no longer be any individual negotiations or arrangements between any of the employees and the employer. Collective agreement matters are now solely between the employer and union. This means that an employee who believes his or her employer has breached the terms of employment can no longer take this dispute to court by themselves, it must be resolved by the union. The unions being responsible for representing all employees in the bargaining unit members or not- gives rise to the free rider problem. Right-to-work legislation: stating that employees cannot be required to become union members or pay dues some argue this encourages free-ridership. Union security clauses: closed shop: employees must be union members before being hired.
